It seems like in cases like this that there should be public polls done. show the kid's picture to 1000 people. based on the percentage of people who say that the kid looks 18 or older he should get less time. if 75% say that the kid looks 18 then he should not serve time. give him probation.50% say the kid looks 18. probation and some time in jail25% say the kid looks 18. 5 years in jail.0% say the kid looks 18 . life in prison.There was a case in the past few years where a man was arrested for having child porn videos. But the actress was not underage. she actually had to the come to the USA and prove the man's innocence that the porn was not child porn and that she was over 18. some people do not look like their age. and especially applies in this case since the 13 year old was looking for sex. It does not sound like he was coerced or was pimped out or anything else.

I have'tn seen the "child" in question, and it's a fair point that he MAYBE should have realized the guy wasn't really 18, but I hit puberty at 9 and had bushy sidechops at 15. Heck, one of my oldest friends had C-cup breasts at 14, so I will never bow to the notion that you should know someone's too young just by looking at them. If someone is actively *trying* to get in your pants, you shouldn't have to check their ID just to avoid being thrown in jail for reciprocating. That said, suing grindr is bullshit, and if the cops go after grindr that'll be bullshit too. Yes, sex is a big deal. Yes, you can fuck up your life if you're careless about it, but we shouldn't be making it a criminal matter unless someone is coerced. If someone is really and truly too young for sex, then they're not going to want it in the first place.
if you are a guy make sure you see some REAL ID in these questionable instances, and if something seems suspicious walk away, if you are a woman you can pretty much do whatever you want and maybe get a slap on the wrist, if the judge is having a bad day...
I actually think the defendant has a case. A while back I saw a Vice documentary featuring a 21 year old who met a girl at a bar and the two decided to go home and have sex. The 21 year old later finds out that the girl was 16 and he's charged and convicted of statutory rape. The question is why? When you go to a bar you have reasonable expectations that everyone who's there is 21 and older. So how is it the 21 year old's fault that someone let a minor in the door? I think the same precedent should be set in this case. If you're on Grindr and meet someone, you have reasonable expectations that the person you're talking to is at least 18. I know grown adults who look like teenagers and they're in their 30s so the notion of "If he's 13 he obviously looks it" is kind of invalid. Younger people can look older and vice versa.As for the 13 year old, I think he's the only one who should be punished. Not the man and not Grindr. At 13 you know exactly what you're doing if you've downloaded an app and trolled for sex. He should be charged with fraud and sued for damages.
